Agreement to Terms

By accessing or using PixelPort ("Service"), you agree to be bound by these Terms of Service. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.

These Terms apply to all users, including photographers, videographers, and their clients who access galleries.

Description of Service

PixelPort is a client gallery platform that enables photographers and videographers to deliver photos and videos to clients, sell prints and digital products, and manage client relationships.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

User Accounts

To use PixelPort, you must create an account. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
Ensuring your account information is accurate and current

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Upload content that infringes on intellectual property rights
Upload illegal, harmful, or objectionable content
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service or servers
Upload malicious code, viruses, or harmful content
Impersonate others or provide false information
Use automated systems to access the Service without permission
Resell or redistribute the Service without authorization

Content Ownership and Rights

Your Content: You retain all rights to the content you upload (photos, videos, etc.). By uploading content, you grant PixelPort a limited license to store, process, and display your content as necessary to provide the Service.

Your Responsibility: You are solely responsible for ensuring you have the right to upload and share all content, including obtaining necessary model releases and permissions from subjects.

Our Platform: The PixelPort platform, including its design, features, and branding, is owned by PixelPort and protected by intellectual property laws. You may not copy, modify, or create derivative works of our platform.

Subscription and Payments

PixelPort offers subscription plans with varying features and pricing. By subscribing, you agree to:

Pay all fees associated with your chosen plan
Automatic renewal unless cancelled before the renewal date
Provide accurate payment information

Refunds: We offer a 30-day money-back guarantee for new subscriptions. Contact support for refund requests.

Price Changes: We reserve the right to modify pricing with 30 days notice. Price changes will not affect your current billing period.

E-Commerce and Sales

PixelPort enables you to sell digital products and prints to your clients. You are responsible for:

Setting appropriate prices for your products
Fulfilling orders and delivering products
Handling customer service for your sales
Complying with applicable tax laws

PixelPort processes payments through Stripe. You agree to Stripe's terms of service. We do not take any commission on your sales.

Data and Backups

While we implement regular backups and security measures, you are responsible for maintaining your own backup copies of important content. We are not liable for data loss resulting from user error, technical failures, or account termination.

Upon account cancellation, your data will be retained for 30 days to allow export, then permanently deleted.

Limitation of Liability

To the maximum extent permitted by law, PixelPort shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless PixelPort from any claims, damages, or expenses arising from your violation of these Terms, your content, infringement of third-party rights, or your violation of applicable laws.

Termination

You may cancel your subscription at any time through your account settings. We may suspend or terminate accounts for violations of these terms with notice when practical.

Upon termination, your right to use the Service ceases immediately. Download your content before cancellation.

Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of PixelPort after changes constitutes acceptance of the modified terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
